DATA PROTECTION POLICY

 

This privacy notice and data protection policy for HC Simulation, LLC (“HCS”) describes how and why it might collect, store, use, and/or share (“process”) customer information when a customer uses HCS’s services.

 

1. WHAT INFORMATION DO WE COLLECT?

HCS may retain customer information disclosed to it during license negotiations (and other correspondence from the customer) for purposes of billing, providing services, and communications with the customer.

 

In providing services, HCS’s policy is that it will accept only de-identified data that does not contain protected health information, nonpublic personal information, or other personally identifying information.

 

HCS does not collect customer data via its website other than general analytic data concerning website traffic and general correspondence submitted via the “Contact Us” page of the website.

 

1. HOW DO WE USE YOUR INFORMATION?

 

HCS will use any de-identified data, Confidential Information, or other customer information received from customer to provide services consistent with the customer’s separately executed HCS Software License Agreement. Any additional specific limitations on the use of de-identified data, Confidential Information, or other customer information will be contained in the HCS Software License Agreement.

 

HCS will not use any information for direct marketing purposes. Further, HCS will not sell your information to third parties.

 

3. HOW DO WE PROCESS YOUR INFORMATION?

 

Any “Confidential Information” (as defined in the separately executed HCS Software License Agreement) provided by a customer during license negotiations or for other reasons shall be handled per the specific requirements pertaining to Confidential Information in the HCS Software License Agreement and/or any separately executed non-disclosure or confidentiality agreement.

 

Any de-identified data will be processed as agreed by HCS and customer for the specific services agreed to. Any HCS services provided for the customer, including model tuning, simulation, evaluation, analysis, and/or prediction, will be performed (a) on Amazon Web Services, Inc. (AWS) cloud based servers or (b) on password protected computers owned and managed by HCS. Data provided will be used to create simulation scripts, and to create comparators to evaluate and tune the simulation for the customer.

 

4.  HOW IS YOUR INFORMATION STORED?

 

Any customer information, Confidential Information, and/or de-identified data received by HCS will be stored on a password-protected personal computer maintained by HCS.

 

5.  HOW LONG DO WE KEEP YOUR INFORMATION?

Any “Confidential Information” (as defined in the separately executed HCS Software License Agreement) provided by a customer during license negotiations or for other reasons shall be handled per the specific requirements pertaining to Confidential Information in the HCS Software License Agreement and/or any separately executed non-disclosure or confidentiality agreement.

 

HCS will either return or destroy/delete any de-identified data received from a customer after the relevant services have been performed.

 

6. NOTIFICATION IN EVENT OF DATA SECURITY BREACH

 

In the event of a data security breach, HCS will provide customers with the notification required by Minn. Stat. Ann. § 325E.61, Miss. Code Ann. § 75-24-29, or similar statute(s) applicable in the relevant jurisdiction.

 

7. UPDATES TO THIS POLICY

 

HCS may update this privacy notice and data protection policy from time to time. The updated version will be provided to all current customers and will be effective as soon as it is received by the customer.
